Cheong Yu Aik is the principal of Cheong Chambers and an Advocate and Solicitor of the High Court of Malaya, admitted to the Malaysian Bar in September 2015.

He practises primarily in litigation and dispute resolution, with experience in commercial and civil litigation, employment and industrial relations, construction and contract disputes, insolvency and debt recovery, defamation, conveyancing and property transactions, and dispute-related advisory work. The firm also accepts selected wills and estate planning matters.

Matters accepted by Cheong Chambers are conducted under Yu Aik’s direct supervision and personal involvement, including legal strategy, key documents and client advice.

CONVEYANCING AND PROPERTY TRANSACTIONS

  • Acted for vendors and purchasers in sales and purchases of multiple parcels of land, including preparation and execution of sale and purchase agreements, stamp duty adjudication and registration of transfers.
  • Advised on title searches, caveats, encumbrances, title conditions, restrictions in interest and approvals required for transfer.
  • Conducted title due diligence for transactions involving multiple parcels of land.

EMPLOYMENT AND INDUSTRIAL RELATIONS

  • Reviewed employment contracts, employee handbooks, confidentiality agreements and performance improvement plans.
  • Advised employers on retrenchment and termination processes.
  • Acted for an employer in an unfair dismissal claim and for an employee in a constructive dismissal claim.
  • In separate matters, acted for employers and employees in judicial review and related High Court proceedings arising from Industrial Court awards.

  • Acted in debt recovery proceedings founded on invoices and delivery notes, including summary judgment proceedings.
  • Acted for a foreign company in proceedings to recover a refund of deposit; the matter proceeded to a full trial.
  • Acted for an electricity supplier in proceedings involving loss of revenue arising from meter tampering.
  • Acted for a company in proceedings against a management corporation concerning maintenance of common property.

INSOLVENCY, WINDING UP AND DEBT RECOVERY

  • Acted for petitioning and responding parties in contested winding up proceedings.
  • Acted in bankruptcy petitions, execution proceedings and related enforcement matters.
  • Advised on summary judgment and available enforcement routes.

CONSTRUCTION AND CONTRACT DISPUTES

  • Acted for a subcontractor in commencing and defending construction claims in CIPAA adjudication proceedings.
  • Advised on contractual claims between contractors and subcontractors and on enforcement or setting aside of adjudication decisions.

DEFAMATION AND REPUTATION PROTECTION

  • Assessed potential defamation claims arising from publications, online statements and written communications.
  • Prepared pre-action correspondence and advised on civil defamation proceedings.
